1. Who we are
Everything 4D LLC ("E4D", "we", "us") is a limited liability company organized in California, USA. Our mailing address is 4083 24th St, Box 460172, San Francisco, CA 94146.
You can contact us at admin@everything4d.com.
2. Scope of these terms
These terms govern your use of this website and of any software, integrations, components or connected applications we publish, including applications registered with third-party providers such as Intuit and Microsoft.
Where we have entered into a separate written agreement, statement of work, proposal or contract with you, that agreement takes precedence over these terms to the extent of any conflict.
3. Software and integrations
We publish applications and integration components that connect customer systems to third-party services. Where you authorize one of our applications to access your systems:
- Access is granted by you, or by an administrator acting on your behalf, through the third party's own consent process.
- The permissions requested are shown to you at the point of consent. We request only the permissions the application needs to function.
- You may withdraw that consent at any time using the administrative tools provided by the third party. Withdrawal will stop the application working, but requires no action from us.
- We do not use access granted for one purpose to perform another.
4. Acceptable use
You agree not to use our software or this website to send unsolicited bulk email, to breach any applicable law, to infringe the rights of others, or to attempt to gain unauthorized access to any system.
5. Availability
We aim to keep our services available and functioning, but our software frequently depends on third-party platforms and services outside our control. We do not warrant uninterrupted or error-free operation except where a separate written agreement expressly provides otherwise. To the extent permitted by law, and except as that agreement provides, our software and this website are provided as is, and we disclaim all implied warranties including merchantability and fitness for a particular purpose.
6. Intellectual property
Unless a separate agreement says otherwise, we retain ownership of our reusable components, libraries, tools and know-how. Rights in work produced specifically for a client are addressed in that client's own agreement with us.
Content on this website is our property or that of our licensors and may not be reproduced without permission.
7. Liability
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for fraud or fraudulent misrepresentation.
Subject to that, our total liability arising out of or in connection with these terms is limited to the amounts paid by you to us in the twelve months preceding the event giving rise to the claim. We are not liable for loss of profit, loss of business, loss of data, or any indirect, incidental, special or consequential loss.
This clause does not override the liability provisions of any separate written agreement between us.
8. Changes
We may update these terms from time to time. The version published on this page is the current one, and the date above shows when it last changed.
9. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in San Francisco County, California have exclusive jurisdiction over any dispute arising out of them.
